摘要
图尔敏的法律论证理论与他的一般论证理论水乳交融。图尔敏不仅是法律论证理论的开拓者,而且其法律论证理论对新兴的"人工智能和法律"研究领域产生了重大影响,尤其是图尔敏模型,不仅被扩展为刻画复杂法律论证的基本模型,而且也被诠释为包括法律解释过程的动态模型。
Toulmin＇ s legal proof theory is in perfect harmony with his general proof theory. Not only is Toulmin the legal proof theory earlier worker, but his legal proof theory has major impact on the emerging ＂the artificial intelligence and the law＂, particularly the Toulmin model, which is not only expanded into the fundamental model to portray complex legal proof, but also annotated to include the dynamic model of law interpreting process.
