加强我国船源污染防治法律制度的对策研究

Studies on the Countermeasures for Law System for Ship Source Pollution Prevention in China

我国船源污染防治法律制度存在法律需进一步落实、管理机构混乱和执法能力有限等弊端,导致我国船源污染海洋防治形势严峻。针对我国船源污染防治法律制度中存在的问题,结合新近出台的《中华人民共和国防治船舶污染海洋环境管理条例》,可以从立法和管理等层面对新时期我国船源污染防治法律制度做进一步完善。

In China, ship source pollution prevention law system has many defects, including further implementation of the law, administration confusion and limited enforcement capacity, which lead to the severe situation of prevention of ship source marine pollution. Focusing on the above problems in the law system, with the newly introduced The People＇ s Republic of China Management Ordinance for Prevention of Pollution from Ships to the Marine Environment, we can further perfect the related legal system on the legislative and management mechanism.
