动物权利论主张将动物纳入法律主体的范畴,但是要成为法律主体必须满足这一逻辑前提,即作为法律秩序内的成员必须对法律秩序和共同规范怀有内在的认同感和自愿服从的义务感,这一逻辑前提决定了理性能力是成为法律主体的必备条件。而动物不具备人类的理性能力,因此不能也不应当成为法律主体。

Advocates of animal rights believe that animals are legal subjects and should be entitled to legal rights.However,by taking this standpoint,those advocates ignore the logical prerequisites for legal subjects.A legal subject is required to have intrinsic recognition and voluntary obedience to the legal system,which sets rational capacity as the logical prerequisite.Due to the lack of rational capacity,animals cannot and should not be legal subjects.
