摘要
"土地涨价归公"和"土地发展权国有"是被征农地增值收益归国有的主要经济依据。但根据产权经济学的相关理论,"土地涨价归公"实际上只能表明政府有权利"分享"被征农地的增值收益,而不表示被征农地增值收益归国家所有;另一方面,从权属性质看,国有土地发展权实际上是权力性质的,政府不能藉此而直接占有被征农地的增值收益。从产权经济逻辑看,被征农地的增值收益应该归农村集体经济组织所有。由于概念本身的模糊性,"土地涨价归公"思想和"土地发展权国有"思想容易混淆政府与市场的边界,导致权利主体错位。
The state-owned land appreciation and the state-owned land development right are the main basis of the state-owned incremental benefit of rural land expropriated.But according to relevant theory of property economics,the state-owned land appreciation doesn't say that the incremental benefit of rural land expropriated belongs to the government,but the government has the right of sharing it.On the other side,the so-called state-owned land development right is essentially a kind of administrative power,and the government can't posses the incremental benefit because it has such power.The incremental benefit of rural land expropriated should belong to the collective organization of the village.Because of conceptual illegibility,the state-owned land appreciation and the state-owned land development right confuse easily the boundary between the government and the market,then inducing us to mistake the government for the owner of the incremental benefit.
