Principle of Harmony Order:to Explain China to the World

法哲学是关于秩序原理的学说。如果说,以英语表达的"自由秩序原理",代表了一种向世界解释欧美主流秩序的法哲学,那么,以汉语表达的"和谐秩序原理",就是一种向世界解释中国本土秩序的法哲学。和谐秩序原理以法哲学的方式,满足了中国和平崛起对于法学理论的需要。以和谐为终极价值、以道义为依据的"和谐秩序原理",较之于以自由为终极价值、以功利为依据的"自由秩序原理",能够更好地建构天下秩序,实现人类大同,满足这个已经全球化了的世界的需要。

Philosophy of law is doctrine on the principle of order.If we say that the ＂principle of liberal order＂ in English represents a sort of philosophy of law that can explain the main order of Europe and the United States,then the ＂principle of harmony order＂ in Chinese is another philosophy of law that can explain native order in China. ＂Principle of harmony order＂ meets the needs of peaceful rise in China by the way of philosophy of law.The ＂principle of harmony order＂ has the ultimate value of harmony,and is based on the moral.On the contrary,the ＂principle of liberal order＂ has the ultimate value of liberty,and is based on the utilitarian.So the ＂principle of harmony order＂ is better able to construct the world order,to achieve common ground of humanity,to meet the needs of the globalization than the ＂principle of liberal order＂.
