承认外国法律效力(以下简称"承认")是国际私法核心的经济功能——"管辖权配置"的体现,而管辖权的配置与管辖权的界定、管辖权的交易和管辖权的交易成本密不可分。"承认"问题的产权理论分析就是运用产权界定、产权交易和交易成本理论,来分析国际私法管辖权配置过程中涉及的问题,进而在具体的历史平台(意大利法则区别说时期)上证明"承认"是国际私法"管辖权配置"的一个表现和一种效率的"治理结构"的体现。

The Admission of Foreign Law （AFL） is the performance of the allocation of jurisdiction,which is the core economic function of Private International Law （PIL） and is closely linked with the definition,transaction and transaction costs about jurisdiction.The Property Right Theory Analysis of AFL is to apply the theory of definition,transaction and transaction costs to study the correlative issues emerged in the progress of the allocation of jurisdiction of PIL,and finally proves that AFL is the performance not only of the allocation of jurisdiction,but also of a kind of efficient ＂governance structure＂ on the specific historical platform （the period of Theory of Statutes in Italy）.
