量刑改革:实践与评析

量刑改革作为新一轮司法改革的重要实践,对其从改革视角进行梳理和审视,对于理解和把握新一轮司法改革的策略、路径可以起到"窥一斑而见全豹"的效果。梳理发现,量刑改革呈现出试错机制不断尝试、地方性特色显著、改革整体性渐趋增强的新动向,体现了对实证研究方法的重视,对地方性知识的尊重和对量刑改革应由多方主体共同推进的规律性把握。同时,通过对量刑改革实践的观察,可以发现改革的推进策略和方案设计都存在问题,因此,应当从这两方面进行完善:在策略上,应当更加充分试错,谨慎建构;在内容上,应当建构多元化的量刑程序制度,并完善包括量刑说理和量刑证据制度在内的配套制度安排。

To tidy up and examine the sentencing reform,which is an important practice of the whole judicial reform,from a reform view,is helpful to comprehend the strategy and path of the new round judicial reform.The paper finds that the sentencing reform has following new trends： The trial-and-error mechanism is constantly attempted,local characteristics are obvious and the unity of reform is strengthened,which show the great attention to the empirical research method,the respect to local knowledge and the grasp of the law that sentencing reform should be jointly promoted by various parties.Meanwhile,the observation of sentencing reform practices implies that there are still some problems both in the promoting strategy and plan design of reform.So to make it perfect,more trial-and-error methods and the cautious construction should be taken on strategy,and on contents a diverse sentencing procedure system should be established and supporting systems including sentencing reasoning and proof system should be improved.
