Methodological Significance and Apocalypse of Rawls′ Pure Procedural Justice

"原初状态"假设是罗尔斯发展正义理论的方法论出发点。他以古典契约论方法为基础,创造性地提出"无知之幕"装置,对将要选择两个正义原则的主体进行知识限制和具体特性设计,使"原初状态"在形式上完全成为一种纯粹的正义程序。这一独特的方法论构建思路对于我们当代社会主义和谐社会建设背景下如何合理理解公正的制度、什么才是公正的制度以及制度如何运行才是公正的等问题具有重要的启示意义。

＂ The original position＂ hypothesis is the starting point of methodology for Rawls to develop the theory of justice. Rawls proposed ＂veil of ignorance＂ , on the basis of method of the classical contract theory , restrained the knowledge on two subjects of the principles of justice and designed its specific characteristics, which made ＂the original position＂ a pure procedural justice in form completely. It＇s revelatorily meaningful for us to understand the justice institutions reasonably, what the justice institutions are, and how the justice institutions function on the background of contemporary socialism harmonious society construction by this unique constructive thinking.
