摘要
有效率的法律制度必须具有有效率的法律责任。在法经济学视角下,针对行为外部性的有效率的法律责任模型为:对负外部性施加正责任,对正外部性施加负责任,对负外部性施加负责任,对正外部性施加正责任。当然,正负责任各有其适用的条件。
Efficient legal system must design liability efficiently. In law and economics perspective, efficient liability model with regard to the externalities of behavior are ： imposing positive liability for the negative externalities, recognizing negative liability for the positive externalities, imposing positive liability for the positive externalities, recognizing negative liability for the negative externalities. Of course, either positive or negative liability has its own application condition.
