On the Supervision on the Inspection of the Civil Execution

现行民事执行制度的设计存在着内生性缺陷,导致实践中大量问题难以解决。这种内生性缺陷是排斥外部监督的必然结果。欲从根本上破解这一难题,必须将其纳入检察监督的体系中。而检察机关作为我国法定的法律监督机关,担当这一重任有着天然的正当性和可行性,是实现执行规范化的必由之路。检察机关对于民事执行的监督能够有效地督促法院纠正错误的执行行为,保障当事人的合法权益,从根本上维护司法权威。

Many inborn defects exists in the present system of civil execution,which contributes to difficulties to solve the problems we meet in practice.This inborn defects are the unavoidable results of excluding exterior supervision.It must be listed in the inspection system in order to solve this problem completely.As the legal supervising institution,procuratorial organs should shoulder this responsibility.This is the inevitable way to realize the normalization of execution.Procuratorial organs' inspection on the civil execution can promote the court to correct its wrong doing in execution,protect the legal rights of the party and preserve the authority of law.
