摘要
从法律角度,雨云是一种气候资源,具备"物"的要素,可以成为法律关系客体;人工影响天气是以公权力为依据的公法行为,其所造成的损害应仅限于非法作业导致的直接损害。国外人工影响天气立法和司法比较成熟,而我国人工影响天气损害的法律救济保障不足、归责不明。在现实立法条件下,应当把人工影响天气损害救济的重点放在事前预防上,尤其是注重公共利益的保护,建立公众参与制度,包括公告制度、听证制度、异议制度,从而有效预防人工影响天气损害的发生。
From the legal angle,cloud is a kind of climatic resource,has "content" elements and can become legal relationship object.Weather modification is based on the law of public power,and its damage shall be limited to the direct damage caused by illegal operations.In many foreign countries,the legislative and judicial practice for weather modification has become mature;but in China,the legal remedy protection for the damage by weather modification is inadequate and the imputation is not clear.In reality,the legislation should focus on the prevention of damage and protect the public interests by establishing public participation system,including the information system,hearing system and opposition system,thus effectively preventing weather modification damage from occurring.
