环境习惯法是人类社会需求的产物,是人们在生产生活中所形成的一种社会规范体系。一般而言,环境习惯法具有较为完整的规则体系,包含了实体性规则、程序性规则,也有特定的执行组织以保障环境习惯法的有效运行。环境习惯法自身具有优点,但也有不足。目前我国正处于环境法制建设与发展的关键时期,如何正确认识环境习惯法所具有的生态保护功能,并对它加以改造,使其服务于环境生态保护的实现,是当前我国学者所面临的时代任务。

Environmental customary law comes forth under the need of human society.It is a kind of social standard system gradually forming during human＇s working and living.Generally speaking,environmental customary law has the complete rule system,including substantive rules,procedural rules.And environmental customary law has enforcement organization to ensure effective operation of environmental customary law.Environmental customary law has advantages,but it has deficiency too.Our country is in its key period of environmental law system construction and development,how to correctly understand ecological protection function of environmental customary law and reform it to promote environmental zoology protection,has been the mission of the times for Chinese scholars.
