论民事强制执行的警务化改造

On the Policelizitional Reform of Civil Compulsory Enforcement

制度性障碍是造成我国法院执行难的主要原因之一。应改变现行由法官行使强制执行权的做法,实行强制执行权与执行审判权分离,将民事强制执行权交由熟悉法律知识且具有司法警察身份的人员行使,同时整合人民法院现有的民事执行机构和司法警察机构,设立执行警务局,实行民事强制执行的警务化改造,以整合司法资源、消除制度障碍、破解执行难题。

One of the main difficulties in the civil judicial enforcement comes from the systematical challenge.The author suggests,from a new perspective,that the right of compulsory civil enforcement be handed over from civil judges to judiciary policemen who have a strong knowledge of law.The approach adopted by the author requires to set up the Compulsory Judicial Enforcement Police Bureau by reforming the present structure of civil enforcement department and judiciary police department in the People＇s Court.Such a reform will be a breakthrough in solving the puzzle of civil enforcement.
