论网络虚拟财产的权利定位

Orientation of Network Virtual Property Right

频繁出现的网络虚拟财产权利纠纷引发了一系列的社会问题,也对传统的法律制度带来了挑战。但目前我国法律的相关规定却是一片空白,对网络虚拟财产的界定也模糊不清。文章认为,网络虚拟财产具有财产的属性,是虚拟性和现实性相结合,具有对时间、空间和技术的依赖性;并将网络虚拟财产分为三类,提出了网络虚拟财产是具有物权和债权双重特性的权利定位。

Frequent virtual property rights dispute has triggered off a series of social problems,which challenges the traditional legal system.But the relevant provisions of China＇s current law are almost a blank with a vague definition.It is believed that the network of virtual property is property in nature.As a combination of the virtual and real,it is dependent on time,space,and technology.The Network property is classified into three categories in this paper.It is claimed that it has double characters as both Network virtue property and creditor property.
