完善我国《精神卫生法(征求意见稿)》的思考

International Human Rights Law and Chinese Law on the Mental Health

起草有关精神障碍者或者调整精神卫生与社会服务体系的国内法应当以国际性的人权法案作为框架,我国目前的精神卫生法草案在人身自由、平等权、隐私权等方面都体现了对国际人权法的适用,但其对某些权利的规定还不完善。结合国际人权法的要求与国内的立法实践,《精神卫生法》草案需在参与权、劳动权和婚育权等方面作进一步的完善。

Drafting the national law of mental disorder or adjustment relationship of the mental health and social services system should be based on the international human rights law as a framework.The current draft law of mental health in China made application of international human rights law on the liberty,equal,privacy rights and so on,but the provisions of certain rights is not perfect.Combining the requirements of international human rights law and domestic legislative practice,the draft need further improved on participate,labour,marriage rights and so on.
