浅议替代性纠纷解决机制的本土化适用

A Brief Analysis of the Localized Applications of Alternative Dispute Resolution in the Harmonious Context

本文着重分析了替代性纠纷解决机制的概念、性质、特点以及美国和日本替代性纠纷解决制度的成熟经验,同时对构建有中国特色的本土化替代性纠纷解决机制进行了思考。

The inevitability and diversity of social contradictions requires that we should find corresponding methods to resolve them. Moreover,to dispose of the increasingly complex contradictions among the people effectively is a main guarantee for building a harmonious society. This paper focuses on not only the concept,nature and characteristics of the Alternative Dispute Resolution (ADR),but also the United States’ and Japan’s considerable mature experience in utilizing this mechanism. In the meantime,the paper gives some thought on the establishment of a localized ADR mechanism embodying Chinese characteristics.
