An Analysis of the Logical Order in the Administrative Action during the Demolition Process——A Perspective of Normative Probability

在行政法层面上,拆迁过程实质上是一个政府行政的过程,包括行政规划、行政征收以及行政许可三种行政行为,且三种行政行为之间的发生有一种应然性的逻辑顺序,不可颠倒。现实拆迁过程中之所以产生诸多矛盾,与不能正确认识拆迁过程中行政行为的合理的应然逻辑顺序有较大关系。因此,应该在正视此种逻辑顺序应然性的基础上对我国现行关于拆迁的法律法规内容进行重构。

On the administrative level,demolishing buildings is essentially a governmental administrative process,including three types of administrative actions administrative planning,administrative charge and administrative licensing.There is an unavoidable probability of the logical sequence in the occurrence among these three administrative actions and can not be reversed.The real reason why there have been many contradictions in the demolition process is greatly related to the reasonable normative logical sequence of administrative action which can not be correctly understood in the process of demolition.Therefore,it is essential to reconstruct the contents of the existing laws and regulations regarding the demolition in China based on the recognition of the inevitable probability of such a logical order.
