摘要
域名、经营者的建筑物外观、店面设计和内部装潢、统一的工作服装、声音、单一颜色成为除商标、商号之外商誉的新型载体,具有识别商品和服务来源的功能。商标、商号等法律制度以保护载体为立法取向,无法将这些新载体涵盖其中,其他主体通过对这些载体的不正当使用,盗用他人商誉的行为得不到规制。论文分析了这些新载体的法律保护现状,提出了通过明确商誉权对所有商誉载体进行一体化保护的思路。
The domain name,the building's exterior of the operator,the design and the internal decoration of the store,staff uniforms,sounds and even a single color have become the new identifying marks besides the trademark and the trade-name.These new carriers of goodwill can identify the source of the goods and the services.The laws about the trade mark and the trade-name are oriented by protecting the carriers and can not cover these them so they are unlikely to prevent the theft of goodwill.This paper analyzes the current status of the legal protections for these new carriers and proposes an approach to integrate protection of all these carriers.
