摘要
在20世纪70年代之前,大多数西方国家都将劳务派遣机构作为营利性职业介绍机构而予以禁止。20世纪90年代以来,在知识经济和全球化的背景下,随着劳动用工的弹性化愈来愈高,有关国家纷纷对劳务派遣制度进行调整和改革,普遍放松对劳务派遣的管制。法国、韩国对劳务派遣的法律规制相对比较严格,美国对劳务派遣始终采取相对宽松政策,德、日等国家则对劳务派遣采取逐步放松管制的态度,加强了对被派遣劳动者的保护,赋予被派遣劳动者"同等待遇",将被派遣劳动者纳入一般劳动保护制度体系,与直接雇用的雇员一样进行相同的保护。
Until the 1970s,services dispatch organization is regarded as the profit-making community-run job agency in most western countries.Since 90s,20 century,against the background of knowledge economy and economic globalization,some countries reformed the system of services dispatch.Services dispatch is in strict control in France and Korea,the regulation in America is relatively loose,and Germany and Japan take the generous policy of services dispatch.And it is of vital importance to firmly safeguard the legitimate rights and interests of services dispatch laborer.
