摘要
济宁医学院附属医院发生死胎、死婴被弃案,卫生部对此出台新批示,但在死胎处理方面仍缺少具体的法律规定,存在着争议。从伦理和法律的角度出发,分析死胎的特殊性,从理论上探讨死胎的法律属性、所有权归属,并对死胎的捐献等特殊情形进行理性的思考,为完善我国相关民法制度提出建议。
Desertions of stillbirths and dead babies had taken place at the Affiliated Hospital of Jining Medical School. The Ministry of Health has issued new regulatory measures regarding this phenomenon, but ambiguities remain in the disposal methods of stillbirth. This paper aims to discuss, from ethical and legal perspectives, legal properties and ownership of stillbirths, as well as donation of stillbirths and other special cases. The author tries to contribute her own opinions to the completion and improvement of current civil law statutes.
