“抢婚”习俗的现代遗留及其民间法处理——黔东南基层司法实践的困惑

Robbing Wedding Customs and the Treatment with Folk Law——Confusion of Judicial Practice in South-east of Guizhou

黔东南苗族婚姻习惯法中表现最为突出的是"抢婚"习俗,随着经济条件的发展,黔东南苗族婚姻习惯法中独特的"抢婚"规则也在悄然发生着改变。一方面是20世纪90年代以前以"抢婚"方式建立的家庭离婚率呈逐年升高趋势;另一方面是国家司法机关的思维意识却没有相应转变,这正逐渐成为一种新的冲突:是司法机关工作人员所理解的"国家法"与苗族村寨群众在改变了原有的婚姻习惯法传统规则后所引起的"特殊冲突",这成为基层司法实践中的新"困惑"。

Robbing Wedding is the most prominent marriages customary law of Miao in South-east of Guizhou Province,in which involved with long-term closed environment,and directly associated with the needs of the productive forces of agriculture in special society.But with the development and changes in economic conditions,many unique marriage customary law of Miao is gradually changed,and followed by the increasing divorce rate building on Marriage Rush family before nineties of the twentieth century;on the other hand,the ideology of the state judiciary has not changed,accordingly,it is becoming a new conflict： the judiciary staff understanding of State Law and the Miao people in the village to change the original customary law of marriage caused by the traditional rules of special conflict,leading to the collision frequently.
