一种本土语境下的司法复活——论我国新式坦白从宽制度的构建

诉讼效率历来是我国法治建设中的一个重要问题。在当前犯罪率加速上升、司法资源缺乏的情况下,提高诉讼效率已经成为一个急需解决的问题。为了提高诉讼效率,诸多学者纷纷前往遥远的西方寻找出路,对于我们脚下的"本土资源"反而视而不见。从打造具有中国气派的刑事诉讼制度谈起,深度剖析我国土生土长的坦白从宽政策。在吸取坦白从宽政策的合理因素的同时借鉴西方成功的法治经验,最终构建具有中国特色的"新式坦白从宽"制度。

The lawsuit efficiency is always an important question in the legal construction in China.Under the current condition of the rising crime rate and deficient judicial resources,raising the lawsuit efficiency has already become an urgent question needed to be resolved.In order to raise the lawsuit efficiency,many scholars go to the remote west to seek for the outlet in abundance,but neglected the ＂native resources＂ under foot.From building the criminal justice system with Chinese style,the author analyzed deeply the native confess lenient policy.Absorbing the reasonable factor of confess lenient policy,the paper proposed to construct the ＂new confess lenient system＂ with Chinese characteristics finally.
