摘要
著作权质押对于激励作品创作具有重要意义。目前的著作权质押存在权利冲突和规范缺失的问题,其根源在于缺乏对精神权利的限制以及对著作权质押法律定位的困扰,因此需要适当弱化精神权利,建立精神权利许可使用的新模式,同时以抵押的观念改造著作权质押制度,进一步完善相关规范。
Copyright pledge is important to incentive works production. Now there exist serious problems such as conflicting rights and imperfect rules in copyright pledge, these problems result from short of restrictions to moral right as well as the position of copyright pledge in legal System. Therefore, it is essential to weaken moral right, establish new pattern of moral right licensing in copyright. Meanwhile, reshape copyright pledge institution by virtue of concept of hypothecation, further perfect relevant regulations and rules.
