摘要
颁布和实施《中华人民共和国海事诉讼特别程序法》是有效实施《中华人民共和国海商法》的需要,是积极履行国际公约规定义务的需要,更是将中国建设成为亚太地区海事司法中心之一的需要。作为一部既具有中国特色又与国际公约接轨的海事诉讼特别程序法律规范,《中华人民共和国海事诉讼特别程序法》在具体司法实践中取得了较好的效果,并有力地推进海事法院管理体制的改革、海事审判程序的完善和海事审判队伍的建设。
The promulgation and implementation of Special Maritime Procedure Law of the People＇s Republic of China is the need of implementing Maritime Code of the People＇s Republic of China effectively,performing obligations under international conventions actively,and building China into one of the maritime judicial centers in the Asia-Pacific region.With Chinese characteristics and in line with international conventions,Special Maritime Procedure Law of the People＇s Republic of China achieves good results in specific judicial practice,and promotes the reform of maritime court management system,the improvement of maritime trial proceedings and the building of maritime trial team.
