网络证据的收集程序是网络证据收集必须遵循的法定程序,因而是网络证据收集法律制度的重要内容。根据网络证据自身的特殊性,正确地规定网络证据收集的法律程序,是网络证据科学立法的基本要求。在立法中规定网络证据收集的法律程序,除了规定网络证据收集程序外,还应当规定启动程序以及证据的生成程序两个部分。网络证据收集的启动程序、证据收集程序以及证据生成程序三个部分应当是网络证据收集法律程序的基本内容。
