试论我国社区矫正全面试行中的监督管理问题

A Discussion on the Supervision and Management Problems of the Community Correction Full Trial in China

社区矫正是一种非监禁性的刑罚执行制度。监督管理既是社区矫正行刑方式的重要体现,也是社区矫正的重要任务之一。社区矫正从试点至今全面试行,各地区司法行政机关建立健全各种监管制度,但在监管理念、内容及措施方面仍存在偏差和不足。司法行政机关应当变革管理观念,完善管理制度,不断探索可操作性强的管理措施,以推动社区矫正的深化与发展。

Community correction is a non-custodial penalty enforcement system.The supervision and management is an important manifestation of the community correction execution,and is one of the important tasks of community correction.Community corrections from the pilot to full trial,the judicial and administrative authorities of all localities have established the various regulatory system,however,there are still some deviations and deficiencies in the monitoring philosophy,content,and measures.The judicial and administrative organs should change the management concept,improve the management system,continuously explore workable management measures,to promote the deepening and development of community corrections.
