低碳经济语境下的赤道原则及其法律问题

The Equator Principles and its Legal Problems in the Context of the Low-Carbon Economy

赤道原则与低碳经济的概念几乎同时同地出现,赤道原则与低碳经济的发展也几乎同步。随着低碳经济的发展,赤道原则也做了重大修改和补充,其低碳环保的特性、操作性和组织化等趋势越来越明显。赤道原则衍生出了一些低碳环保法律问题,包括赤道原则的性质、贷款人的法律责任、融资法律文件的条款问题。我国的低碳环保立法应当借鉴赤道原则,增设贷款人的应有注意义务,并在融资法律文件中增加低碳环保条款。

The Equator Principles and the concept of the low-carbon economy almost arose at the same time,with the Equator Principles and the low-carbon economy development also simultaneously.Along with the development of the low-carbon economy,the Equator Principles are significantly modified and supplemented,and the trends of its characteristics of low-carbon,operability and organization are more and more obvious.The Equator Principles have derived some low-carbon legal issues,including the legal nature of the Equator Principles,the legal responsibilities of the lender and the articles of the financing legal documents.The low-carbon and environmental legislation in China should learn from the Equator Principle,and add the reliability of the due diligence to the lenders and add the low-carbon articles to the financing legal documents.
