缓刑是当代刑罚制度的宠儿,被认为是抗制犯罪的特种刑罚手段,但我国缓刑制度自引进之日始直至现今从未真正发挥过有效作用,长期处于功能缺失和功能失常状态。造成这种局面的原因是非常复杂的,而刑法学界对缓刑功能的漠视和长期缺乏深入研究则是其中的一个重要原因。研究缓刑功能实现的目的是要把处于应然、可能状态的缓刑功能转化为实然的、现实的功能状态。

The resons that lead to the Current siuation is very complicated, among which the ignorance and lack Of deep research in the function of probation from the criminal justice organizations is a very iinpOrtar t one. The purpose to study the realization of fuiaetion of probation is to convert such function from the slate of being Supposed and possible to that of being actual and practical.
