摘要
非居住房屋租赁合同纠纷是租赁合同纠纷中常见的一种,其与居住房屋租赁在诸多方面存在区别,但在司法实践中经常出现将两者法律一体适用的不合理现象。本文从类别基础、实践基础、经济基础和法理基础等方面,对非居住房屋租赁的特殊性进行了论述,并在参考国外相关立法例的基础上,提出对非居住房屋租赁的使用权、续展权和租赁权转让方面予以特殊立法的相关立法建议。
Non-residential real property lease contract dispute is one of the commonly seen lease contract disputes.Although there are differences in many aspects between a residential and a non-residential real property lease,the same articles are applied to contract disputes in both cases in our judicial practices,which is unreasonable.This article discusses particularities of the bases of non-residential real property lease in terms of categories,practices,economy and jurisprudence,and with reference to foreign corresponding legislation,comes up with suggestions about amending some articles and adding some particular articles in our relevant laws concerning the use,renewal and transfer rights of non-residential real property lease.
