我国公民义务教育权的法理分析

义务教育权是宪法赋予公民的一项基本权利。义务教育权兼有自由权与社会权的双重属性。虽然义务教育权的社会权性质愈加浓厚,但是其自由权性质也应当受到重视。义务教育权的实现需要国家、教师与家长三方共同行使相应的义务,但家长的选择权应当受到尊重。宪法规定接受义务教育是公民的基本义务,目的在于充分保障公民义务教育权的实现。

The right of compulsory education is a fundamental constitutional right of citizens.It has the dual property of both liberty and social right.Although its social right is being stronger and stronger,we should pay attention to the property of liberty.Government,teachers and parents should coordinate themselves efforts to realizt the right of compulsory education.What＇s more,the right of election of the parents should be respected.It is the obligation for the parents to ensure their children to enter school when they reach the school age,which is the more important for the government.The constitution prescribes that it is the fundamental obligation for the citizens to accept education,the purpose of the provision is to fully ensure citizens＇ right of compulsory education.
