对我国居住权制度有关问题的思考

摘要 居住权制度在我国的发展并不完善,在《物权法》中缺失的主要原因可归结为社会与法律两个方面。实践中,应当将居住权在婚姻家庭法中的发展作为突破口,通过"物权法+有关单行法"的多元立法体例,在我国的民法典体系内最终应当正式建立一个以物权法为核心、相关特别法为补充的全面现代的居住权制度,恢复其独立物权种类的法律地位。 The development of the system of the right to housing in China is not complete, and lack of the system in the "property law" results from social and legal problems. In practice, it is necessary to establish an all-round modern system of the right to housing with the "property law" at the core, and relevant specific laws as a complement, taking adding the right to housing to the marriage and family laws as a break-through, and using the plural legislative style:the "property law plus relevant special Daws".
