摘要
作为特殊契约的劳动合同,无固定期限劳动合同有别于原始标准契约的法律关系决定了劳动者一方自身所处的弱势地位。这必然要求劳动合同法立法通过形式不平等的利益倾斜方式保护劳动者,实现实质意义上的利益平衡。以无固定期限合同为立足点,透过其利益倾斜之现状,从而找寻利益倾斜的合理性,进而找出利益倾斜之阻碍因素,最终构想出相应的解决方案。
An unfixed term labor contract is a special contract. Its legal relationship, which is different from the original standard contract, creates a weak position of workers. This necessarily requires the legislation on labor contract law to take different kinds of inequality away to protect the interests of workers, and to achieve real sense of balance of interests. With unfixed term contracts as a foothold, through its present status of interests tilt, the author looks for the rationality of interest tilt, and then finds out the hindering factors of the interests tilt, and ultimately conceives the corresponding solutions.
