法律翻译研究:内容与思路

A Review Study of Legal Translation

法律翻译是法律转换和语言转换同时进行的双重工作,它包括法律笔译和法律口译。通过对近年来国内外法律翻译研究的内容、视角以及方法的梳理,本文总结了法律笔译和法律口译研究的成果及不足,并结合法律翻译的实质,指出影响和评判法律翻译的关键因素,应是交际目的、法律语言的文体特征和语用特征、不同法律体系与法律制度下的法律文化差异。

Legal translation referring to both legal translation and legal interpretation is a dual operation of both legal transfer and language transfer. On the basis of the discussion of the contents, the perspectives and the research methodology, this paper analyzes the strengths and the weaknesses of the research of legal translation and court interpreting both home and abroad in the past few decades. In conclusion, the author defines the very nature of legal translation and values on such key factors as communicative objectives, stylistic and pragmatic features of legal language, and differences of legal cultures in doing the legal translation and interpretation.
