摘要
试用期制度是劳动合同的重要组成部分,也是用人单位重要的人才筛选工具。《中华人民共和国劳动合同法》的颁布,在一定程度上影响了其筛选机制作用的发挥。文章从经济学角度分析了试用期筛选机制的原理,并结合合同法中对试用期长度、试用期待遇等方面的具体规定,提出了正式录用后的工资率的制定标准应在一个合理的范围内,试用期的筛选功能才能得到充分发挥的切实可行的操作性建议。同时指出,要想试用期筛选机制更好的运行,用人单位应该采取多种激励考核手段、同时劳动者也应该提高自身的知识能力水平,通过雇佣双方的共同努力来保证试用期筛选功能的充分发挥。
The probation system is an important part of the labor contract,and is also an important screening tool to the employers.The enacting of "The People's Republic of China Labor Contract Law" affect their screening mechanism play its role to a certain extent.This paper analyzes the principle of trial screening mechanism from the economic view.Combining with the specific provisions about the length and treatment of the probationary period,It gives us the operational recommendations that the formal wage rates should be within a reasonable range in order to exert function well.At the same time,in order to make screening mechanism work better,the employer should take a variety of incentives assessment tools,and the workers also should improve the level of their knowledge and ability.Both employers and employees should make their efforts to ensure the function of the probation system work well.
