保护遗传资源及相关传统知识,对构建发展中国家和发达国家在国际自由贸易中的公平秩序,保护各方利益,具有重要意义。可对遗传资源及相关传统知识的保护,却是国际知识产权制度忽略的方面,没有得到有效的法律保护。在中国与东盟自由贸易区中,各成员国的遗传资源及相关传统知识相当丰富,因此自由贸易区应加强在遗传资源及相关传统知识领域方面的法律保护与合作。

Effectively protecting the genetic resources and traditional knowledge is very important for the developing countries and the most undeveloped countries against the background of the international trade, and concerned with the interests of the developing countries and the most undeveloped countries. In tradition, genetic resources and associated traditional knowledge are not within the scope of the intellectual property, and are not protected by international intellectual property law. Because of members in China-ASEAN Free Trade Area with rich genetic resources and associated traditional knowledge, it becomes more and more an important issue on how to strengthen their legal cooperation in the field of genetic resources and associated traditional knowledge.
