Government by Law:the Only Way of Jail Crisis Management

监狱在应对各类危机事件的具体实践中存在诸多问题,如传统思维和行动约束、思想意识淡薄以及监狱危机管理制度供应不足。建立监狱危机管理制度应遵循四个原则:应急管理原则、信息公开原则、权利保障原则、积极预防原则。监狱危机管理法治化是监狱工作的必然取向,实现危机管理法治化的基本要素包括了以法律授权的形式,建立监狱应急法规体系;构建规范处置机制,健全监狱危机管理制度;从法益保护的视角,理顺危机管理职责权利;强化人员素质,提升警察危机管理意识。

There are many problems in the concrete practice of jails dealing with each kind of crisis event,like the traditional thought and the motion restraint,the light ideology,as well as the insufficient supply of jail crisis supervisor system.To establish the jail crisis management system should follow four principles： the emergency management principle,the information public principle,the right safeguarding principle,and preventing positively principle.The jail crisis management in government by law is inevitable orientation of the jail work,to realize the crisis management in government by law shoud include the legal authorization form,establish the jail emergency laws and regulations system;construct standard handling mechanism,perfect jail crisis management system;from law profit protection angle of view,straighten crisis management responsibility right;strengthen the personnel quality to promote police crisis management consciousness.
