摘要
附条件不起诉制度是我国近些年来热烈讨论的一种不起诉制度。将其冠名为附条件不起诉具有合理性;其性质是检察官的自由裁量权,是一种待诉权;其效力应具有形式效力和实体效力;其与我国的酌定不起诉制度有相似之处,但也存在很大的区分。
Conditional non-prosecution system has received heated discussion in recent years.It is reasonable to attach conditions to its title. Its nature is the prosecutor＇s discretion,a right to appeal.And it should have both formal and physical effect.It is similar to our country＇s system of discretion not to prosecute,but there is a big distinction.
