关于完善我国商业秘密保护法律体系的探讨

Reflections on the Perfection of China's Business Secrets Protection Legislation

随着改革开放的深入和社会主义市场经济的发展 ,我国商业秘密立法步入了快车道。在总结我国商业秘密保护立法的成就并分析其现实缺陷的基础上 ,提出了要进一步完善我国商业秘密法律体系 ,必须遵循科学的立法原则 ,转换立法模式 ,同时 ,对未来《商业秘密保护法》的基本架构作了勾画。

With the deepening of reform and opening to the outside as well as the development of socialist market economy, China's business secrets legislation is stepping into fast track. This article, after reviewing China's achievements in legislation for protecting business secrets and analyzing its actual defects, points out that the legislation mode must be transformed and scientific principles must be followed in order to perfect China's business secrets law system. Besides, the article has outlined the framework of future 'Law of Business Secrets Protection'.
