摘要
鉴于我国权力腐败、社会腐败等问题的凸现,要求执政者"为政以德"的呼声也日益强烈。我国提出了"以德治国"的方略,由于未能准确把握先秦时期儒家德治思想的真谛,将重点放在对老百姓的道德教化,而不是重在要求执政者实行"法治下的德政",因而收效甚微。本文认为应当在法治的前提下,通过道德的社会权力化,使之成为约束执政者权力的辅助力量。"为政以德"还要求"良心入宪",要求执政者恪守政治伦理和司法伦理。
Due to the corruption of power and the society,the requirement of "virtuous politics" is more intense.Due to the incorrect grasp of Confucian rule-by-virtue idea of Pre-Qin Period,although the slogan of "rule-by-virtue" is put forward,it is lack of effect,because the focus is mistakenly put on the people to be virtuous,but not on the ruler.This article believes that the power of the society should be limited by the standard of morality in the present rule-by-law environment."To rule-by-virtue" should be combined with "Conscience included into the Constitution".The authority should abide by political ethics as well as judicial ethics.
