权利保护的经济理论与中国转型期的地权流转

The Economic Approach to the Protection of Rights and Land Transfer in the Term of Chinese Reform

权利保护的经济理论认为,在权利转让方式中蕴含着权利保护的经济逻辑,权利转让是联系个体利益和社会整体利益的纽带,因此,个体权利的保护应该在社会整体的最优目标中来考察。通过对中国转型期地权流转的考察发现,中国的土地产权是一种没有防护的权利,权利的内在缺陷是导致失地农民利益受损和土地财政膨胀的主要根源。

The economic logic of the protection of fights lies in the transfer of rights. The transfer of rights is the liaison between the interests of individuals and the interests of society. Therefore the protection of rights should be studied from the perspective of the optimal target of society. After studying the transfer of land rights in the term of Chinese reform, it is found that the land rights in China are put out of any kind of protection; the land rights without protection are the major reasons of the harm of farmers who lost land and the inflation of land finance.
