民权思想在社会各个阶层的传播和深入人心,使体现这种思想的立法权在整个国家权力中处于绝对的主导地位,大陆法系国家水到渠成地形成了立法主导的法律运行模式。西方不成其为问题的立法独立,由于我国历史上民权思想的缺失,却成为中国特有的重大问题,造成了我国从大陆法系国家移植的立法主导的法律运行模式难以有效运转。

The immense popularity of the civil right ideology with people from all walks of life in the west results in the dominance of legislation-the embodiment of civil right ideology-in their state power.Therefore,the countries adopting the civil law system developed a legal system predominated by legislation.On the contrary,the lack of civil rights ideology in China makes the independence of legislation an exclusive problem for China and the Chinese legal system borrowed from the legislation-dominated countries unsatisfactory.
