周恩来法治观的发展脉络与思想内容探析

Probing ZHOU Enlai's Development Context and Ideological Contents on the View of the Rule in Law

在法治的宏观认识上,周恩来坚信法治在治国中的重要性,但也有"德法兼治"的主张。至于法治的立法、执法、守法等微观层次,在立法方面,周恩来阐述了立法和立法机关的重要性、渐进立法的必要性和完备法制的迫切性等内容;在执法方面,周恩来就依法办事、公正执法、执法中的严宽相济、建设执法队伍等阐明了主张;在守法方面,周恩来提出了培养守法意识和党员干部带头守法等观点,并有明显的辩证守法观。鉴于种种条件的限制,这些主张和观点难免不够深入、系统或成熟,但绝不影响其历史和现实价值。

On macro-understanding of the rule in law,ZHOU Enlai has clearly convinced of the importance of the rule of law in the country. However,there are also ＂Combining the Rule of Law with the Rule of Virtue＂ proposition. As for the micro-perspective of the legislation,the enforcement and the compliance,in the legislative aspect,Zhou elaborated the importance of legislation and the legislature,the necessity of progressive legislation,the urgency of a comprehensive legal system and so on. In the law enforcement aspect,Zhou elaborated ideas on accordance with the law,impartial law enforcement,the temper justice with mercy and the construction of enforcement team.In compliance aspect,Zhou proposed cultivating respect for the law,the Party members and cadres to take the lead law-abiding and had a clear view of the dialectical law-abiding. Given all sorts of condition＇s limit,these ideas and views will inevitably not go far enough,systems or mature,but in no way all these affect the value of its history and reality.
