关于代理放弃治疗伦理依据的探析——由天津肛闭女婴事件引发的思考

Analysis on Surrogate Withdrawing Treatments' Ethical Foundation:Reflection on Female Infant with Imperforate Anus Affair of Tianjin

代理放弃治疗是放弃治疗中较为有争议的一种形式,它涉及到的一个基本伦理问题是由代理人做出的放弃治疗决定在何种情况下可以得到伦理辩护。合理代理放弃治疗有三种情形,它们的伦理辩护依据是尊重患者自主,或者是在患者自主意愿缺失或不可辨的情况下,尽可能维护患者最佳利益。

The surrogate withdrawing treatment is a controversial form of withdrawing treatments, which relates to a basic ethical problem, that is,in which case the surrogate withdrawing treatment can be defensible. This paper analyses three defensible surrogate withdrawing treatments, whose ethical basis is respecting the patient＇s autonomy, or protecting the patient＇s best interests as soon as possible when the patient never be autonomous or the patient＇s autonomy can not be cognizable.
