摘要
在当前公私法不断交融的趋势下,行政权也越来越多地渗入到版权领域。从"卡拉OK版权费用风波"的个案中可以看出,若要规范行政权对版权的影响,必须转变辨析知识产权公私属性的价值分析方法,借助霍菲尔德基本法律概念的分析法学工具,才能厘清行政权在版权领域的真正作用机制。
Public and private law continued in the current trend of blending,administrative rights are more and more into the field of copyright.Based on the ＂Kara OK royalties storm＂ of the case study shows that the executive power to regulate the impact of copyright,private property must change the value of intellectual property rights discrimination analysis,the basic legal concepts with Hohfeld＇s analysis of law tools to executive power in the copyright area to clarify the true mechanism of action.
