摘要
私法不属于法而属于法律,并且属于法律中的国内法。国际法与私法公法的区分无关,但私法是国际法的基础。民法是基本私法和普通私法。私法体系包括了效力从高到低的三个层次,即宪法性私法、民法和特别私法,这种私法体系观与目前学界盛行的民法加商法的私法体系观截然不同。
The private law belongs to not justice but rules.The private law belongs to domestic law and is the base of international law.Civil law is general and basic private law.The system of private law includes three levels from high to low,which are constitutional private law,civil law and particular private law.Obviously,this view on private law system is different from the currently popular view on private law,which regards private law as civil law plus commercial law.
