摘要
流通抵押权在工业化发达国家法律中早已有规定并得到成功的实践,它对我国市场经济中的资本市场发展也有重要的借鉴意义。应该通过对流通抵押权相关的基本法律理论进行分析,找出一条适合我国抵押权得以流通的道路,以便促进我国金融产业发展,进而促进整个社会经济持续繁荣。
The flow of mortgage in the developed countries has already been provided in laws and successfully implemented. Its development is also an important reference for Chinese capital market . Based on the analysis of the basic legal theory of the flow of mortgage - related in order to find a suitable way to develop the flow of mortgage in our country. It can promote the development of Chinese financial industry, thereby promoting the continued economic prosperity.
