摘要
相当数量的离退休老人,由于他们具有无需培训等优势,仍在劳动,即"返聘"。但这部分特殊劳动者却未纳入劳动法律的保护范畴,有诸多风险。应从"返聘"概念界定入手,剖析《劳动合同法》和《劳动法》对离退休返聘人员排除适用的原因,明确其法律属性和特点,进而分析我国立法不足,并加以完善。
China has a considerable number of retired elderly people are still working,which is "Fanpin" phenomenon.And because they do not have the training and other advantages,leading "Fanpin" widespread.But some workers have not been included in the special protection of labor law context,there are many risks.From "Fanpin" concept defined start analyzing the "Labor Contract Law" and "Labor Law" exclude the application of retired officers Fanpin reason,define its attributes and characteristics of the law,and then analysis of the inadequate legislation,and to be improved.
