摘要
我国派遣公司迅速发展,但因为就业结构、立法缺陷等原因,派遣公司设立制度需要完善。目前,派遣业公司化趋势为劳动派遣公司设立制度的完善提供了契机,立法的成熟为劳动派遣公司设立制度的完善提供了借鉴资源,而我国法律的兼容性为劳动派遣公司设立制度的完善提供了改革空间。应抓住现有时机,从设立人、设立资本要求、许可制度、经营范围等方面进一步完善我国劳动派遣公司设立制度。
In recent years,it has the formation of a complete law system as a result of setting up the Labor dispatch of legislative reform in developed countries' companies.However,in China,there are still many shortcomings in legislation and practice about the Labor dispatch companies' establishing.Therefore,improving system of our Labor dispatch companies' establishing need to set up the specific system from the eligibility requirements for the establishment and the establishment of human diversity requirement;requirements for diversification of capital;the business scope of the specification;the franchise of the issues and the establishment of licensing requirements to send the company and so on.
