对农村群体性事件的宪政思考

国家尊重和保障人权是宪法的基本原则,然而现实生活中农民作为公民的基本权利缺失成为了一种常态,这是导致农村群体性事件发生的根本原因,而农民利益表达机制的缺失又是直接导致农村群体性事件发生的制度因素。因此,回归农民的公民身份,对农村群体性事件进行宪政思考是解决问题的关键所在。文章首先从宪法语境分析农民的含义及其宪法地位,其次分析我国农民在结社自由权、村民自治权、财产权、劳动权、社会保障等权利缺失的状况,最后剖析了我国现有制度安排在农民利益表达方面存在的诸多问题,进而得出解决农村群体性事件的根本渠道是尊重宪法还权于民的结论。

It is the basic principle of constitution that a country respect and guarantee citizen＇s rights.But in fact,It is a kind of normal state that peasantry as a citizenry is short of the basic rights.That is the root cause of rural group affairs,and the lacking of peasantry＇s interest express mechanism is the system element.So,regaining peasantry＇s citizenry identity and thinking of rural group affairs from the constitutional direction is the key to solve the problem.The article at first analyse the meaning and constitutional position of peasantry,then analyse the conditions of peasantry rights lacking in property right,labour right and so on.At last dissect plenty of questions in peasantry＇s interest expressing and win a conclusion that the basic medium to solve rural group affairs is respect constitution and return the rights to peasentry.
