现阶段黑恶势力犯罪的特点及打击对策研究

A study on Characteristics and Countermeasures of Gang-Crimes at Present Stage

现阶段黑恶势力犯罪呈现形式更新快、滋生周期短,软暴力倾向明显、利益攫取领域蔓延、政治领域渗透加剧、多种犯罪合流、由弱转黑现象凸显等特点,与此同时由于思想认识的不同、法律规定的粗放、保护伞的存在、机制的不完善等原因导致打黑除恶工作中存在多重障碍。立法先行是打黑的必要前提,各部门形成联动、工作机制的完善、情报信息的获取等是打黑除恶工作持续深入的有效保障。

Gang-crimes increased quickly with some new characteristics,such as new ways of committing crimes emerged,gang-crimes are more profit-oriented and politics-oriented,many types of crimes combined together with gang-crimes,and weak group of the society developed into gangs and committed crimes,etc.Meanwhile,there are many obstacles for the police while fighting against gang-crimes because of the different understanding of the crimes,some illegal protections to the crimes,and the disadvantages of the law and the current policing mechanism.To fight against gang-crimes,lawmaking should assert its precedence,cooperate between different law and justice departments,sticking to intelligence-led policing,and improving the policing mechanism are of great importance at the same time as a multi-functional supporting system.
